The learned A.G.A. has provided the copy of written instruction received by him. On the basis of the said instructions, it is sought to be submitted that the statements of the prosecution witnesses under section 161 Cr.P.C. have been recorded and the statement of the victim-girl could not be recorded as she continuously remained ill and had died.
The submission is that the Investigating Officer is proceeding to conclude the investigation and seeks three weeks' time to do the needful.
In view of the above statement, without entering into the merits of the claim of the petitioner herein, the writ petition is disposed of with the observation that the Investigating Officer shall make an endeavour to conclude the investigation as expeditiously as possible preferably within a period of one month from today. In case any slackness or delay on the part of the Investigating Officer, it would be open for the petitioner to approach this Court again.
