Heard learned counsel for the petitioner and learned A.G.A. appearing for State and perused the record.
This application under Section 482 Cr.P.C. has been filed with the prayer to direct Sub Divisional Officer, Kirawali, District Agra to expedite Case No.T201801010400867 (Girraj Singh Versus Balvir Singh) and decide the same within a stipulated period.
Learned counsel for the petitioner has submitted that the application under Section 133 Cr.P.C. was moved by the petitioner on 15.07.2014 and notice to opposite party no.1 was issued. Thereafter, on 09.05.2018 Sub-Divisional Magistrate/Officer,Kirawali,District Agra has been returned the notice under Section 133 Cr.P.C.The petitioner approached before learned Additional District Judge, Court No.17, Agra by way of filing Criminal Revision No.268 of 2018 against order dated 09.05.2018. The revision was allowed and the matter was remanded back to opposite party no.2 for further proceedings but till date case has not been decided by the respondent no.2.Therefore, respondent no.2 may be directed to decide aforesaid case within a stipulated period.
In view of aforesaid, the respondent no.2 is directed to decide Case No.T201801010400867 (Girraj Singh Versus Balvir Singh) moved by the petitioner in accordance with law as expeditiously as possible, preferably within a period of three months from the date of receipt of a copy of this order.
Under above observation/direction, instant application under Section 482 Cr.P.C. is disposed of finally.
