Heard Mr. Rizwan Ullah Siddiqui, learned counsel for petitioner and learned AGA for State.
This writ petition under Article 226 of Constitution of India has been filed challenging order dated 08.02.2020 passed by respondent 3, Commissioner, Saharanpur Division, Saharanpur in Appeal No. 00456 of 2021, Amzad vs. State of U.P., under Section 6 of U.P. Control of Goondas Act, Police StationKandhla, District Shamli.
At the very outset, learned counsel for petitioner contends that due to inadvertence order dated 13.10.2020 passed by respondent 2, District Magistrate, Shamli could not be challenged. He therefore, contends that present writ petition be dismissed as not pressed with liberty to file fresh.
Prayer made by learned counsel for petitioner is not opposed by learned AGA.
Accordingly, present writ petition is dismissed as not pressed with aforesaid liberty.
