This is a writ petition filed under Article 226 of the Constitution of India seeking to stay the effect and operation of the impugned order dated 24.03.2018 passed in Appeal No. 1160 of 2016 whereby the appeal of the petitioner was dismissed under Section 3/4 of UP Control of Gunda Act whereby the order of the Upper District Magistrate, Finance and Revenue, Deoria dated 13.06.2016 has been confirmed in Case No. D2014052000104 under Section 3 of U.P. Control Gunda Act.
The submission of the learned counsel for the petitioner is that the order of externment for six months was passed on 13.6.2016, which has elapsed for more than four years back, thus this petition has become infructuous by efflux of time.
In view of the above, this writ petition has become infructuous and it is, accordingly, disposed of.
Interim order, granted earlier, stands discharged.
