It is submitted by learned counsel for the appellant that the appellant is Bijali@Amit Yadav and one Ravi Anand Verma barged, uninvited marriage ceremony and started demanding meals. On this account, there was scuffle between the appellants with Manish Ram, (injured) and other persons. As per version of the FIR, the appellant has given knife blow over his stomach causing serious injuries to the person of the injured. The startling features of the case is that 161 Cr.P.C. statement of Manish Ram, annexed as Annexure-7 to the application in which he has attributed the role of giving knife blow to the applicant that he has assaulted upon his stomach whereas the co-accused too has assaulted upon him. The injured states that he sustained three knife blow injuries over his person. Surprisingly, the injury report indicates that the injured has sustained only one injury over his stomach. There is one stabbed wound over the right side of the chest 3 c.m. lateral to the sternum, belying the allegations of the injured, who candidly submits that he has sustained three injuries over the person. The injured has also submitted that the appellant and one Ravi Anand Verma have assaulted upon the injured by their respective knives but fact remains that the appellant has sustained only one stab wound over his person. Thus, the appellant and Ravi Anand both were attributed the role of assault but the injured have sustained only one knife blow over his stomach. Who is the author of that grievous injury, is million dollar legal question. It is next contended that appeal of co-accused Ravi Anand Verma has already been allowed by the court below on 21.12.2020 itself and therefore, it is not clear as to who is the author of the single injury caused to the injured. The appellant is languishing in jail since 14.12.2020.
