The instant application has been filed for cancellation of bail of opposite party no. 2 - Prabhjeet Singh granted by the Chief Judicial Magistrate, Ghaziabad vide order dated 10.12.2019 in Case Crime No. 86 of 2017 under Sections 420 and 506 IPC, Police Station Indrpuram, District Ghaziabad.

Learned counsel for the applicant contends that the opposite party no. 2 has violated and breached the conditions of bail, thus his bail may be cancelled and a direction may be issued to conclude the trial expeditiously.

Sri Dinesh Goswami, learned Senior Advocate assisted by Sri Atul Mehra, learned counsel for opposite party no. 2 has vehemently opposed the bail cancellation application and submitted that the opposite party no. 2 has never violated any of the conditions of bail and the applicant herein has failed to point out any evidence in support of his contention.

I have heard Sri Lal Chandra Mishra, learned counsel for the applicant, Sri Dinesh Goswami, learned Senior Advocate assisted by Sri Atul Mehra, learned counsel for opposite party no. 2, learned AGA for the State and perused the record.
