Learned counsel for the applicant has submitted that the applicant has been falsely implicated in the present case due to enmity with the police. The applicant is a labourer. He was arrested by the police on 31.12.2020 with 500 gram Alprazolam. According to first information report, the incident occurred in the market, which is beside the applicant's house, but police has not recorded the statement of the witnesses. He has further submitted that the applicant has not committed any offence as alleged in the first information report. At the time of arrest, mandatory provisions of NDPS Act has not been complied with by the police authorities. Nothing has been recovered from the possession of the applicant and the alleged recovery is false and fabricated. There is no independent eye witness of the alleged recovery, which has been shown by the police. The applicant is having no previous criminal history and in case he is released on bail, he will not misuse the liberty of bail. The applicant is in jail since 01.01.2021.
