It is submitted by learned counsel for applicant that applicant is innocent and falsely implicated in this very case crime number. As per the FIR, on the information received by the informant (Mukhbir), the applicant and other coaccused namely, Sufiyan were arrested from the house of co-accused, Sufiyan while they were making injection for animal regarding increasing the milk quantity. It is further submitted that during search some liquid, some bottles of phenol (Carbolic Acid) and some bottles of ascetic acid 400 ML were recovered. The recovery is false and fabricated for which there is no independent witness. It is also submitted that the liquid which was alleged to have been recovered from the joint possession of the applicant and other co-accused person has not been sent for any chemical analysis. There is no allegation of animal cruelty is mentioned in the FIR and as such no offence punishable under Section 11(3) of Animal Cruelty Act, 1960, has not been made out against the applicant. It is next submitted that all the sections which are levelled against the applicant are bailable except section 420 of IPC, which is triable by Magistrate. Applicant is of no criminal antecedents and is languishing in jail since 18.01.2021. There is no likelihood of fleeing from course of justice or tampering with evidence. Hence, bail, during trial, has been prayed for
