It is contended by learned counsel for the applicant that the applicant is innocent and he has falsely been implicated in the present case. The applicant is not named in the first information report. It is next contended that four country made pistol of 315 bore, two cartridges of 32 bore, one cartridge of 12 bore, half manufactured pistol along with manufacturing instruments and Rs. 210/- are alleged to have been recovered from the possession of the applicant. It is next contended that the entire recovery is false and planted, for which there is no independent witness. It is lastly contended that the applicant other criminal history of 15 cases, which has been explained in paragraph 6 of the supplementary affidavit, out of which, in five cases, he has been acquitted and in rest of the cases, he has been enlarged on bail. The office is traible by Magistrate. He is in jail since 3.11.2020 and in case he is released on bail, he will not misuse the liberty of bail and will cooperate in trial. There is no prospect of trial of the present case being concluded in near future due to heavy dockets.
