Heard learned counsel for the applicant through video conferencing. Learned A.G.A. is present in the Court.

This is a bail application on behalf of the applicant Sonu Rai in connection with Case Crime No.103 of 2020, under Sections 323, 363, 376D I.P.C. and 5/6 POCSO Act, Police Station Gahmar, district Ghazipur.

The submission of learned counsel for the applicant is that the applicant is quite innocent and has been falsely implicated in the present case with the ulterior motive. He submitted that the co-accused Sonu Yadav has been admitted to the concession of bail by another Bench of this Court by order dated 18.06.2021 passed in Criminal Misc. Bail Application Nos.8933 of 2021 and the role assigned to the applicant is similar to the role of the other co-accused, who has already been enlarged on bail. He claims parity. He submitted that the applicant is languishing in jail since 14.05.2020, hence he is entitled to be released on bail and he will not misuse the liberty of bail and will cooperate in the trial.

Learned A.G.A. has opposed the bail plea.
