Learned counsel for the applicant argued that the applicant is innocent; he has been falsely implicated in this very case crime number and is languishing in jail since 22.03.2018;he is of no criminal antecedent; First Information Report was got lodged against other five accused persons, wherein, informant Thakur Lal had said himself to be an eye witness account of occurrence, wherein, fire arm shot was given by Netra Pal, causing death of the deceased Sukki; subsequently, on the basis of hear say, the informant side were made accused in this very case crime number; the alleged call detail record is of Babua and Jitendra @ Jeetu; the applicant is of no concern with the above call detail; even up to that stage his name was not there, subsequently, in the confessional statement of Babua he was said to be involved in above occurrence; except confessional statement of Babua no evidence against the applicant is there; the said confessional statement is inadmissible because it was made before the Police, during investigation; the alleged recovery of Tamancha is planted one; no such recovery was there; Babua has already enlarged on bail by coordinate Bench of this Court, in Criminal Misc. Bail Application No. 42957 of 2018; other co-accused Jitendra @ Jeetu has been enlarged on bail in Criminal Misc. Bail Application No. 24510 of 2018; there is no likelihood of applicant's fleeing from course of justice or tempering with evidence in case
