Learned counsel for the applicant submits that the allegation against the applicant is that he was involved in breaking A.T.M. and implements used in the crime were recovered. The recovery of Rs.5,20,000/- has been made from the joint possession of the applicant and two co-accused persons along with country made pistol. The recovery has been connected to Case Crime No.136 of 2020. He further submits that the coaccused Arif @ Munna, Ajjar and Rahul, who have been enlarged on bail by co-ordinate Bench of this Court vide orders dated 30.09.2020, 01.10.2020 and 05.10.2020 in Criminal Misc. Bail Application Nos.28799 of 2020, 30114 of 2020 and 30489 of 2020, respectively, therefore, the case of the applicant stands on identical footing, the applicant is also entitled for bail on the ground of parity. He next submits that there is no possibility of the applicant of fleeing away from the judicial process or tampering with the witnesses and, in case, the applicant is enlarged on bail, the applicant shall not misuse the liberty of bail. It is next contended that there is no criminal history of the applicant and he is languishing in jail since 16.11.2020.
