Heard Sri V.P.Srivastava, learned Senior Counsel assisted by Anshul Tiwari, learned counsel for the applicant, Sri Ravindra Pratap Singh, learned counsel for the informant, learned AGA and perused the material brought on record.
Pleadings between the parties have been exchaged and the matter ripe-up for final disposal.
The applicant is facing prosecution in case crime no. 676 of 2020, under Sections 302, 34 IPC, P.S. Kavinagar, District Ghaziabad and is languishing in jail since 17.05.2020.
As per the text of the FIR, the same was lodged by Sachin Kumar on the same day of the incident i.e. on 07.05.2020 at 8.30 a.m. for the incident said to have been taken place on 5.35 a.m. in the morning against sole named accused persons, namely, Vinod Kumar and one more unknown person. As per the text of the FIR, the informant's mother Ms. Anita Devi went for morning walk and at the same time informant's uncle (Fufa), the applicant, resident of the same Mohalla Lane No. 5, Kailashpuram-II along with one unknown persons came to her and given a fatal shot by firearm causing her instant death. Learned counsel for the applicant has drawn the attention of the Court to the inquest report of the deceased. The inquest report shows that the dead body of the deceased was lying at MMG Hospital, Ghaziabad. As per the inquest report, the deceased has sustained a gun shot injury over her left temple. Her autopsy report annexed as Annexure-3 to the affidavit
