It is argued by the learned counsel for the applicants that as per the prosecution case, on 04.12.2020 FIR has been lodged against four accused persons namely Afroz (applicant no.1), Islam (applicant no.2), Fariyad (applicant no.3) and Akram alleging inter alia that on 04.12.2020 four cows have been recovered from the possession of the applicants and one person Akram succeeded in fleeing away from the place of spot. It is also mentioned that two knife, one axe (Gadasa) and one rope were also recovered from the possession of the applicants. The main substratum of argument of learned counsel for the applicants is that admittedly applicants were not found committing slaughtering of cows in this case. They have been falsely implicated in the present case by the police and the recovery memo is not supported by any independent public witness, therefore, false implication of the applicant cannot be ruled out. It is next contended that there are no chances of the applicant of fleeing away from the judicial process or tampering with the prosecution evidence. The applicant is languishing in jail since 05.12.2020. They does not have any criminal history to his credit. In case, the applicants are released on bail, they will not misuse the liberty of bail.
