Heard Sri Babul Kumar Sharma, learned Counsel for the applicant and Sri Vivek Rastogi, learned A.G.A. for the State respondents.

It is contended by learned Counsel for the applicant that the applicant is wholly innocent and has been falsely implicated in the present case. It is further submitted that nothing incriminating has been recovered from the possession of the applicant or at his pointing out and there is no independent witness of the said incident. It is also contented that no one has received injury in the said incident and there is no injury report. The criminal history of the applicant has been explained in para 2 of the supplementary affidavit to the satisfaction of the Court. It is further contended that the co-accused Anand Patel has been granted bail by a co-ordinate Bench of this Court in Criminal Misc. Bail Application No. 8608 of 2020 vide order dated 4.3.2020. It is further submitted that there is no possibility of the applicant fleeing away from the judicial process or tampering with the witnesses. In case, the applicant is enlarged on bail, he shall not misuse the liberty of bail. The applicant is in jail since 9.7.2019.

Learned A.G.A. has opposed the prayer for bail but could not dispute the aforesaid facts.

Perused the first information report as well as the averments made in the bail application.

Considering the facts and circumstances of the case and also perusing the material on record, without expressing any opinion on the merit of the case, let the applicant Rohit @ Rankendra Khangar involved in case crime no.129 of 2019, under Sections 307, 411, 120B I.P.C., P.S. Garsarai, District Jhansi be released on bail on his furnishing a personal bond and two local sureties each of the like amount to the satisfaction of court concerned on the following conditions that:

the applicant shall not temper with the prosecution evidence.

the applicant shall not pressurize the prosecution witness;

¶12

the applicant shall appear on each and every date fixed by the trial court.

In case of default of any of the conditions enumerated above, the order granting bail shall automatically be vacated.
