Learned counsel for the applicant has submitted that initially the first information report was lodged under section 308 IPC. Later on, the injured Rabbey Alam died then it was converted into section 304 IPC. Only Mast Raj Singh was named as accused in the initial first information report. Later on, the names of 13 persons were also added after about two weeks. Learned counsel for the applicant has further submitted that similarly placed co-accused Markandey Gupta has already been enlarged on bail by another Bench of this court, vide order dated 21.10.2020, passed in Criminal Misc. Bail Application No. 31725 of 2020, co-accused Deepak Dubey @ Deepu has also already been enlarged on bail by another Bench of this court, vide order dated 21.10.2020, passed in Criminal Misc. Bail Application No. 31594 of 2020 and co-accused Rajan Sharma has already been enlarged on bail by another Bench of this court, vide order dated 14.10.2020, passed in Criminal Misc. Bail Application No. 32004 of 2020 and the Copies of the bail orders have been annexed as annexure no. 8 of the affidavit. He further submits that since the role of the applicant is identical to the other co-accused who have already been granted bail by the another Bench of this Court, hence the applicant is also entitled to be enlarged on bail.
