It is argued by the learned counsel for the applicant that as per prosecution case, two bags each containing 25 Kgs of beef were recovered from the possession of the applicant and co-accused Shan Mohammad. It is further submitted by the learned counsel for the applicant that two other accused persons, namely, Muslim and Banti have been shown to be fled away from the place of occurrence. Main substratum of argument of learned counsel for the applicant is that co-accused Shan Mohammad has already been granted bail by co-ordinate Bench of this Court vide order dated 19.11.2020 in Criminal Misc. Bail Application No. 40253 of 2020. It is contended by the learned counsel for the applicant that the case of the present applicant stands of similar footing to that of co-accused Shan Mohammad, therefore the applicant is also entitled to be released on bail on the ground of parity. There is no prospect of trial of the present case being concluded in near future due to heavy dockets. The applicant has no criminal history to his credit. The applicant is languishing in jail since 05.09.2020 and in case he is enlarged on bail, he will not misuse the liberty of bail.
