alone went to the house of accused-applicant in the mid night. Again, it has been submitted that the first information report has been lodged after 14 days from the date of incident, which is an unreasonable delay and the benefit of which, should go to the accused-applicant. Submission is that when the victim was examined under Section 164 Cr.P.C., she has also stated that when the accused-applicant called her, she without informing her family members went with him. which is also an unusual fact for a woman aged about 25 years. It has also been submitted that some phone came on the mobile of her sister Rehana is also not established when the call details were obtained by the I.O. It has been further submitted that the brother of the accused-applicant namely Nafisul Hasan gave an application dated 10.02.2020 to several authorities making complaint that the victim is a notorious woman having relations with so many notorious persons and she is inclined to harass the family members of the accused-applicant and forcing for marriage with the accused-applicant. She also demanding Rs. 10 lakhs and on being denied she is threatening to implicate all the family members in the criminal case. Further submission is that after this complaint made to the several authorities, then only the first information report was lodged on 21.02.2020. The accused-applicant is prepared to furnish the surety and bond and is giving undertaking that he will cooperate in trial. It has been submitted that the applicant has criminal history, as alleged against the accused-applicant, are of substantial nature. Learned counsel for the applicant has further submitted that there is no possibility of fleeing away from the judicial process or tampering with the witnesses and in case, the applicant is enlarged on bail, the applicant shall not misuse the liberty of bail. The applicant has been in jail since 04.09.2020, hence, he is entitled to bail.
