Learned counsel for the applicant submits that as per F.I.R. version informant Riyazul Haq was in need of land, therefore, he contacted Shamshad Alam @ Chhote, who told that he has to sell the land for which informant paid cash of Rs.1,85,500/- to Bakaullah by executing a notary deed on 17.10.2017 on which signature of the informant is also appended and on 02.11.2017 Shamshad Alam @ Chhote executed a written deed on which there is signature of the informant, in the deed amount of Rs.4,85,500/- is mentioned, some amount has been deposited in the account of Shamshad Alam @ Chhote and some amount in the account of Ujma Khatoon daughter of Kamare Alam @ Jhinnu and Rs.2,10,000/- was taken by Kamare Alam @ Jhinnu regarding which a video recording is available. A receipt was also given on 23.06.2017 and Rs.3,14,000/- also has been received on different dates by Kamare Alam @ Jhinnu and Shamshad Alam @ Chhote. It is further submitted that dispute is of civil nature. He further submits that co-accused Shamshad Alam @ Chhote has been already granted bail by co-ordinate Bench of this Court vide order dated 16.06.2020 in Criminal Misc. Bail Application No.35707 of 2019, therefore, the applicant is also entitled for bail. There is no possibility of the applicant of fleeing away from the judicial process or tampering with the witnesses and, in case, the applicant is enlarged on bail, the applicant shall not misuse the liberty of bail.
