It is contended by the learned counsel for the applicant that the victim Razia, in her statement under Section 164, Cr.P.C., copy of which has been filed as annexure-7 to the affidavit, has stated that out of her own freewill, she had gone with the applicant. It is also contended that the applicant has been falsely implicated in this case due to ulterior motive for the purposes of harassment. It is next contended that there are no chances of the applicant of fleeing away from the judicial process or tampering with the prosecution evidence. It is further contended that the applicant is in jail since 13.11.2020 and if he is released on bail, he will not misuse the liberty of bail.
Learned A.G.A. has opposed the prayer for bail.
