Heard learned counsel for the applicant, learned A.G.A. for the State and perused the material on record.

The present bail application has been filed by the applicant with a prayer to enlarge him on bail in Case Crime No. 627 of 2020, under Sections 392, 411 I.P.C., Police Station Tajganj, District Agra.

Learned counsel for the applicant submits that on 8th August, 2020 three persons looted a bag having kundal, mangal sutra, ring and money etc. He submits that on 30th September, 2020 applicant and three other co-accused were arrested by the police and on the basis of recovery of alleged looted jewelleries and also confessional statement he has been implicated in the case. There is no possibility of the applicant of fleeing away from the judicial process or tampering with the witnesses and, in case, the applicant is enlarged on bail, the applicant shall not misuse the liberty of bail. It is next contended that there are 8 criminal history of the applicant which have been explained in paragraph 9 of the affidavit and he is languishing in jail since 1.10.2020.

Per contra, learned A.G.A. has opposed the bail prayer of the applicant but could not dispute the aforesaid fact.
