It has been submitted by learned counsel for the applicant that the applicant is innocent and has been falsely implicated in this case due to ulterior motive. In gang-chart annexed as Annexure No. 2, four criminal case being Case Crime No. 177 of 2020, under Sections 379, 411 I.P.C.; Case Crime No. 207 of 2020, under Sections 457, 380, 411 I.P.C.; Case Crime No. 225 of 2020, under Sections 379, 411 I.P.C. and Case Crime No. 228 of 2020, under Sections 382, 399, 402 I.P.C., which are related to theft, stolen property etc., in which applicant has been enlarged on bail by court below; copies of the said bail orders have been annexed as Annexure No. 3 of the affidavit filed in support of the bail application. Apart from this above criminal cases, there are four other criminal cases against the applicant being Case Crime No. 472 of 2016, under Section 25 Arms Act; Case Crime No. 605 of 2018, under Section 307 I.P.C., both were registered at P.S. Tappal District Aligarh; Case Crime No. 377 of 2020, under Section 25 Arms Act, and Case Crime No. 378 of 2020, under Section 414 I.P.C., both were registered at P.S. Kasna District G.B. Nagar, in the aforesaid cases, applicant has also been released on bail by the court below, copies of bail order has annexed in Annexure No. 4 of the affidavit filed in support of bail application. It is next contended that there is no other criminal antecedent to his credit. It is next contended that applicant is neither a member of any gang nor a gang leader and he is not involved in any anti-social activities as alleged by the prosecution in the first information report.
