Learned counsel for the applicant submits that according to the F.I.R. version applicant issued five cheques, four cheques of amounting Rs.5,00,000/- and one cheque of amounting Rs.15,00,000/- total Rs.35,00,000/- but when the cheques were presented before the Bank same cheques were dishonoured. He further submits that a Complaint Case No.301/2019, under Section 138 Negotiable Instruments Act, Police Station Bahjoi, District Sambhal has also been filed by the informant, which is pending before Civil Judge (Senior Division)/A.C.J.M., Chandausi District Sambhal. He also submits that the matter pertains to N.I. Act, this case has filed for harassment of the applicant. There is no possibility of the applicant of fleeing away from the judicial process or tampering with the witnesses and, in case, the applicant is enlarged on bail, the applicant shall not misuse the liberty of bail. It is next contended that there is criminal history of the applicant, which is explained at Para 8 of the rejoinder affidavit and he is languishing in jail since 07.08.2019.
