Learned counsel for the applicant submits that applicant is innocent and has falsely been implicated in the case; the name of the applicant has surfaced for the first time in the confessional statement of co-accused, Ravindra Yadav, real brother of the applicant before the police. Criminal history of four cases has been shown against the applicant which has been properly explained by learned counsel for the applicant.Co-accused Ravindra Yadav and Lalu Yadav alias Golu have already been released on bail by the order of coordinate Benches of this Court, vide order dated 10.12.2020 and 9.02.2021 passed in Criminal Misc. Bail Application Nos. 40606 of 2020 and 5162 of 2021. Further submission is that except the confessional statement of the co-accused, there is no other cogent and reliable evidence against the accused-applicant. The applicant is in jail since 07.07.2020 and that in the wake of heavy pendency of cases in the Court, there is no likelihood of any early conclusion of trial and thus, the applicant is entitled for indulgence.
