Contention raised by learned counsel for the applicant is that one Mr. Ramesh has lodged the present F.I.R. on the same day of the incident on 16.10.2019 under Section 306 I.P.C. against the applicant, his Bhabhi and mother with the allegation that marriage of the deceased was solemnized about fourteen years back and the couple were blessed with two daughters and a son. There was a constant pinpricks given by all the family members of the husband to the deceased and she has committed suicide by hanging herself. As per the postmortem report, there is a ligature mark around the neck of the deceased. The doctor has opined that she has died due to asphyxia as a result of antemortem hanging. During the course of investigation, the police has recorded statement of two daughters of the deceased in which they have accepted the bad habit of their father that he is a habitual drinker and having all sorts of intoxication. In the stage of intoxication, he used to maltreatment their mother. On earlier occasion too, their mother had made an attempt for her life, but due to providence she was saved. No doubt habit of a drinker and taking intoxication is very bad and ruined number of domestic houses, but it is not such a reason for which one can take his own life. The deceased seems to be hyper sensitive lady and out of which she has taken her life. It is further contended that the children of the applicant are leading an orphan life and there is nobody to look after them.
