Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record of the present bail application.

The present bail application has been filed by the applicant Anil Yadav @ Anil Kumar Yadav with a prayer to enlarge him on bail in Case Crime No. 209 of 2019, under Sections 419, 420 467, 468, 471, 384, 504, 506 I.P.C., Police Station Cantt, District Varanasi.

Learned counsel for the applicant has submitted that he has been falsely implicated in this case. The offence alleged is of civil nature and has no criminal antecedent. The applicant has been languishing in jail since 10.11.2020.

Learned A.G.A. has vehemently opposed the contentions made by the learned counsel for the applicant.

From the perusal of the F.I.R, it is found that the allegations are made in regard to preparing forged will and on the basis of the same the name was got mutated in municipal records and the same was showed to be transferred. The offence alleged is of civil nature.

In view of the facts and circumstances of the case and the submissions made by learned counsel for both sides and going through the record, without commenting on the merits of the case, I find it a fit case for bail.

Let applicant(s), Anil Yadav @ Anil Kumar Yadav, be released on bail in the aforesaid case crime number on his furnishing a personal bond and two reliable sureties of the like amount to the satisfaction of the court concerned with the following conditions:

(i) The applicant(s) shall not indulge in any criminal

activity.

(ii) The applicant(s) shall not tamper with the prosecution evidence.

¶15

(iii) The applicant(s) shall not pressurize the prosecution witnesses.

¶16

(iv) The applicant(s) shall regularly appear on the dates fixed by the trial court unless his personal attendance is exempted by the trial court.

In case of default of any of the conditions enumerated above, liberty is given to the trial court to cancel the bail of the applicant(s) without any reference to this Court. Order Date :- 20.1.2021/PS
