Heard learned counsel for the applicant, learned A.G.A. for the State and perused the material on record.
The present bail application has been filed by the applicant with a prayer to enlarge him on bail in Case Crime No. 114 of 2021, under Section 2/3 of U.P. Gangster & Anti Social Activities (Prevention) Act, Police Station Murad Nagar, District Ghaziabad.
Learned counsel for the applicant submits that in the gang-chart only one case has been mentioned in which he has been enlarged on bail by the court below. Apart from the gang-chart no other case is registered against the applicant. He further submits that applicant has a criminal history of 8 cases which have been explained in Paragraph- 10 of supplementary affidavit. The co-accused Prashant @ Chhotu, Devesh @ Debu and Prashant have been granted bail by co-ordinate Bench of this Court vide orders dated 21.05.2021, 24.06.2021 & 20.07.2021 in Criminal Misc. Bail Application Nos. 20571 of 2021, 20546 of 2021 & 19910 of 2021, therefore, the applicant is entitled for bail on the ground of parity. There is no possibility of the applicant of fleeing away from the judicial process or tampering with the witnesses and, in case, the applicant is enlarged on bail, the applicant shall not misuse the liberty of bail. It is next contended that applicant is languishing in jail since 09.03.2021.
