The instant bail application was filed by the applicant, who is facing incarnation since 16.10.2019 in connection with Case Crime No. 698/2019 Under Sections 304,419,420,467,468,471 I.P.C. and Under Section 3/15 Indian Medical Council Act, 1956, Police Station Kotwali, District Fatehpur.
The prosecution case as flows from lodging of FIR by one Shri Sharjan on 14.10.2019 U/s 304A I.P.C. but after investigation, the police has submitted charge sheet under the aforementioned sections of penal code.
The applicant, Dr. R.N. Singh (Ramanand Singh) and one more unknown person was made accused with the story that the informant’s son Lavkush (aged about 15 years) was down with fever and was admitted in local Archana Hospital, Abunagar, District Fatehpur on 04.10.2019 and was medically attended by Dr. R.N. Singh (Ramanand Singh) and his staff members and during the treatment, the father/informant has deposited Rs. 80,000/- as fee and other charges but on the account of utter carelessness on the part of applicant, the boy took his last breath on 14.10.2019 around 2.00 p.m.. It is alleged that even after his expiry, the dead body was not handed over to the informant and demanded Rs. 3.00 lacs from the father. Sensing that his son is not responding then only the doctor has revealed that his son has died. Leaving the dead body of his son, the informant got the present FIR registered at police station at 18.50 hours on 14.10.2019 itself.
