It is submitted by the learned counsel for the applicant that as per the prosecution case, the F.I.R. of the present case was lodged by the informant Raj Kishor Tiwari against the applicant and 5 other co-accused persons alleging that when he was returning home on 30.12.2020 after dropping his wife at Saraswati Balika Vidya Mandir Inter College, Mahoba, on the way he saw a white Scorpio bearing registration No. U.P. 91 J 7316 which over took him ahead Government Girls Inter College and hit him near the house of one Kamlesh Gupta on account of which he lost his balance and fell down and in the meantime 5 persons came out of the said Scorpio and pulled him inside the car. It is further alleged that one accused put a revolver on his temporal region while other four accused persons assaulted him in the car. The informant kept on shouting for rescue while they drove the car upto Subhash Chauki, where a traffic constable got stopped the car and rescued him. The incident is said to have taken place around 10:15 hours. In between the incident, the applicant snatched the golden chain from the neck of the informant.
