Heard learned counsel for applicant(s), learned A.G.A. and perused the record.

This bail application has been preferred by the accusedapplicant(s) Vinod Kumar, who is involved in Case Crime No. 723 of 2020 under Sections 406,420 I.P.C., and 66D Information Technology Act, P.S.- Jalalabad DistrictShahjahanpur.

Learned counsel for the applicant has submitted that the applicant has been falsely implicated in this case. The FIR has been lodged with the allegation that in the website of MRF Tyre Limited on 2nd November relating to Quasba Jalalabad a request has been made for taking distributor and request was accepted and on demand of Rs. 1,45,800/- was deposited in the Bank account mentioned in the FIR. Further, demand of Rs. 1,50,000/- was made. Thereafter, the informant suspected and lodged FIR against unknown persons. During investigation in the statement of informant Yuvraj the another account number 2837101013684 came into light in which the alleged amount of Rs. 1,45,800/- was stated to be deposited. The same was in the name of Babli C/O Ugrapal. The applicant is not the beneficiary of the said account and the same is not in the name of the applicant. The applicant has no criminal history and has been languishing in jail since 26.12.2020.

Learned AGA opposed the contentions made by learned counsel for the applicant and contended that the account holder Babli in his statement stated that it was the applicant-accused who has stated that the amount of Rs.3,50,000/- of Indira Awas Yojana would come in her pass-book through aforesaid account number. The amount was taken by the applicant and the same was also recovered from the possession of the applicant.

Admittedly, the account in which the alleged amount of Rs. 1,45,800/- was deposited is not in the name of the applicant and account holder of the same is Babli.

In view of the facts and circumstances of the case and the

submissions made by learned counsel for both sides and going through the record, without commenting on the merits of the case, I find it a fit case for bail.

Let applicant(s) Vinod Kumar be released on bail in the aforesaid case crime number on his furnishing a personal bond and two reliable sureties of the like amount to the satisfaction of the court concerned with the following conditions:-

(i) The applicant(s) shall not indulge in any criminal activity.

¶14

(ii) The applicant(s) shall not tamper with the prosecution evidence.

¶15

(iii) The applicant(s) shall not pressurize the prosecution witnesses.

¶16

(iv) The applicant(s) shall regularly appear on the dates fixed by the trial court unless his personal attendance is exempted by the trial court.

In case of default of any of the conditions enumerated above, liberty is given to the trial court to cancel the bail of the applicant(s) without any reference to this Court.
