Heard learned counsel for the applicant, Sri Digvijay Tiwari, learned counsel for the informant and learned A.G.A. for the State.

This anticipatory bail application has been filed on behalf of the applicant seeking anticipatory bail in Case No.982 of 2017 arising out of Case Crime No. 361 of 2016, under Sections 147, 148, 149, 420, 467, 468, 471, 307, 504, 506, 509 and 323 IPC, P.S. Iglas, District Aligarh.

At the very outset, Sri Digvijay Tiwari, learned counsel for the informant has contended that applicant has got criminal history.

Considering the submissions and taking into consideration the facts and circumstances of the case, obviously so far as this case is concerned, cognizance was taken in the year 2017 but no doubt from the perusal of the FIR that applicant was involved in the offence in the question. Therefore, the argument advanced here are argument to be advanced at the stage of regular bail and cannot form the basis of anticipatory bail.

The applicant has got remedy to approach the court below for redressal of his grievance. Therefore, application for protection in the form of regular bail should be moved by the applicant before the court concerned. If such application is moved by the applicant, then court below shall consider the same and pass appropriate orders in accordance with law.

In view of above, this anticipatory bail application is disposed off.

The observation so made in the body of this order shall not prejudice proceeding of the lower court while deciding the case on merit.
