Heard Sri Ravi Kumar Mishra, learned counsel for the applicant and Sri Pankaj Saxena, learned AGA-I appearing for the Stateopposite party no.1.
Learned AGA-I points out that from a bare reading of the order dated 16.01.2021 it is apparent that in terms of the said order the application filed by the applicant seeking disposal of the proceedings on the basis of a final report stated to have been filed in an earlier criminal case bearing No. 253/2017 under Section 3/7 of Essential Commodities Act, has been rejected. It is further pointed out that the material on record does not indicate that the applicant has been summoned in proceedings of Case No. 2404 of 2017 under the Weights and Measures Act and as such the present application under Section 482 Cr.P.C. is premature.
Learned counsel for the applicant has not disputed the aforesaid factual position and states that he does not wish to press the application at this stage and prays for its withdrawal.
The application stands dismissed accordingly.
