Heard learned counsel for the applicant, learned AGA for the State and perused the record.
This application under Section 482 CrPC has been filed by the applicant with a prayer to direct the learned Chief Judicial Magistrate, Fatehpur to decide the Criminal Case No. 2164 of 2000 (State Vs. Ajay Jagwan), arising out of Case Crime No. 441 of 1997, under Sections 420, 406 IPC, Police Station Kotwali, District Fatehpur within stipulated period.
Learned counsel for the applicant has submitted that applicant is the first informant in the present case and charges have already been framed on 15.11.2002, however since then, trial has not yet been concluded and has been lingering-on, on one pretext or the other.
In view of the above, learned court below is directed to make all endeavours to conclude the aforesaid trial as expeditiously as possible, preferably within a period of ten months from the date of filing of certified copy of this order without giving any unnecessary adjournments to either parties, if there is no other legal impediment in concluding the aforesaid trial.
