Heard Sri Anil Kumar Jaiswal, learned counsel for the applicants, Sri J.B. Singh, learned counsel for opposite party no.2 as well as learned A.G.A. for the State and perused the material available on record.
The present application under Section 482 Cr.P.C. has been filed for quashing the entire proceedings of Criminal Case No. 960 of 2018 (State vs. Ram Ratan and others), arising out of Case Crime No. 113 of 2018, under Sections 406, 420 of IPC, Police Station- Rabupura, District- Gautam Budh Nagar, pending in the court of Judicial Magistrate Jevar, Gautam Budh Nagar as well as the impugned charge-sheet dated 13.07.2018, on the basis of compromise dated 01.02.2021 which is annexed as Annexure no.1 to the short counter affidavit.
Learned counsel for the applicants as well as learned counsel for opposite party no.2 has stated that a compromise has been entered between the parties as the both sections are compoundable.
There is no requirement of any order from this Court in this regard. However, the applicants are at liberty to move an application for compromise within 15 days from today before competent court who shall pass appropriate orders in accordance with law considering the factum of compromise as early as possible.
With the aforesaid observation, this application under Section 482 Cr.P.C. is disposed of finally.
