Heard Sri Vinay Kumar Singh Chandel, learned counsel for the applicant, learned A.G.A. for the State and perused the record.
This application u/s 482 Cr.P.C. has been filed seeking the direction to expedite the trial of Case No. 3369 of 2004 (New Case No. 6831 of 2011); State Vs. Kavindra & Anr.; arising out of Case Crime No. 184 of 2002, under Sections 379 and 411 I.P.C., P.S. Sector 58 Noida, District Gautam Buddh Nagar, pending in the Court of learned Chief Judicial Magistrate, Gautam Buddh Nagar.
Learned A.G.A. has no objection on the prayer made by the learned counsel for the applicant.
In the facts and circumstances of the case the lower court concerned is directed to expedite and conclude the proceeding of the aforesaid case within six months without granting any unnecessary adjournment to either of the parties, unless there is some legal impediment or unless there is any order passed by the higher court staying the proceedings of the case.
With the aforesaid observation, this application is disposed of finally.
