Heard Sri Ashwini Kumar Srivastava, learned counsel for the applicant and Sri Sanjay Sharma, learned AGA appearing for the State-opposite party no.1.

The present application under Section 482 Cr.P.C. has been filed with a prayer to issue a direction to the court below to decide the case bearing Criminal Case No. 796 of 2020, renumbered as Case No. 9438 of 2020 (State of U.P. vs. Ankit and others), under Section 414 IPC, arising out of Case Crime No. 135 of 2019, P.S. Rohata, District Meerut pending in the court of Additional Chief Judicial Magistrate, Court No.5, Meerut within a stipulated time period.

Learned counsel for the applicant submits that an FIR dated 31.05.2019 was registered against three persons including the applicant by the informantopposite party no. 2 as Case Crime No. 135 of 2019, under Section 414 IPC, P.S. Rohata, District Meerut and a charge sheet in the aforesaid case has also been submitted on 21.01.2020. He further submits that the applicant has applied for the post of Constable pursuant to an advertisement for "Constable Civil Police & Constable PAC Recruitment Exam 2018-II" and has been declared selected. He submits that the aforesaid pending criminal case would adversely prejudice his future prospects and accordingly a direction be issued to the court below to decide the case expeditiously.

Learned AGA appearing for the State-opposite party no.1 has no objuection to the prayer made by the counsel for the applicant.

In view of the aforementioned facts and circumstances, without expressing any opinion on the merits of the case, this application is finally disposed of with an observation that the court below would make an endeavour to decide the aforesaid case in accordance with law, as expeditiously as possible, without granting any unnecessary or long adjournments to either of the parties, provided there is no other legal impediment.
