Heard learned counsel for the applicant and learned Additional Government Advocate for the State.
By means of this application under Section 482 Cr.P.C. the applicant has prayed for early disposal of the pending Criminal Case No.5113 of 2020 arising out of Case Crime No.1580 of 2009 under Section 406 IPC, Police Station Sahibabad, District Ghaziabad pending in the court of Additional Judicial Magistrate, Court No.5, Ghaziabad.
It is argued by learned counsel for the applicant that the charge had been framed in the year 2014 and the trial is still going on due to the non-cooperation on the part of the prosecution witnesses. It is further submitted that dereliction on the part of the prosecution is resulting in an unnecessary harassment meeted out to the applicant.
Learned AGA has no objection if the direction is issued to the court concerned for early disposal of the trial within a time bound period.
Accordingly, the present application is disposed of with direction to the court below to conclude proceedings of the trial within a period of six months from the date of production of copy of this order.
The concerned Court/ Authority/ Official is further directed to verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
