Heard learned counsel for the applicant, learned A.G.A. and perused the record.
The present application under section 482 Cr.P.C. has been filed for quashing the order dated 27.02.2020 passed by Additional Sessions Judge-I, Gorakhpur in S.T. No. 309 of 2011 (State Vs. Jai Prakash Maurya and others), arising out of case crime no. 347 of 2009, under Sections 147, 148, 304 IPC, P.S. Barhalganj, District Gorakhpur, whereby non bailable warrant has been issued against the applicant.
Learned counsel for the applicant has submitted that the applicant is willing to move application for recall of the non bailable warrant dated 27.02.2020 passed by the court below.
Learned A.G.A. vehemently opposed the contentions.
The applicant is to appear before the court concerned within 30 days from today and may move application for recall of the non bailable warrant dated 27.02.2020 and the court concerned shall dispose of the said application, expeditiously, according to law.
With the above observations the application is disposed of .
