The sole relief pressed by learned counsel for the applicant is for directing the Court below i.e. Civil Judge (Jr. Div.)/FTC, Mathura to decide the Misc. Case No. 2300 of 2018, pending before it, within a stipulated period as may be fixed by this Court.
I have perused the record as well as the order-sheet brought on record. From the order-sheet it transpires that the case is being adjourned on one pretext or the other and only the dates are being fixed.
Having heard learned counsel for the parties and without entering into the merit of the case, the instant application is disposed of with a direction to the Court concerned to consider and decide the aforesaid case, in accordance with law, as expeditiously as possible, preferably within a period of two months from the date of presentation of a copy of this order, provided there is no legal impediment.
