Heard learned counsel for applicants, learned A.G.A. for the State and perused the record.
This application u/s 482 Cr.P.C. has been filed by the applicants for a direction to court below for expeditious disposal of Execution Case No.589 of 2017 (Smt. Sudha Pathak and another Vs. Saurabh Pathak) under Section 128 Cr.P.C., arising out of Maintenance Case No.288 of 2016, under Section 125 Cr.P.C. pending in the court of Principal Judge, Family Court, Mau.
It is submitted by learned counsel for applicants that application filed by applicants under Section 125 Cr.P.C. was allowed by the Principal Judge, Family Court, Mau vide order dated 16.2.2017. The applicants had filed an application under Section 128 Cr.P.C. for execution of the order dated 16.2.2017 which was registered as Misc. Case No.589 of 2017 which is pending for last 3 years. Prayer has been made to expedite the Execution Case No.589 of 2017.
Considering the facts and circumstances of the case, the Principal Judge, Family Court, Mau is directed to decide the Execution Case No.589 of 2017 (Smt. Sudha Pathak and another Vs. Saurabh Pathak) filed under Section 128 Cr.P.C., expeditiously preferably within a period of three months from the date of production of copy of this order.
With the aforesaid directions, the present application U/s 482 Cr.P.C. is disposed of.
