Heard Sri Abhishek Misra, learned counsel for the petitioner and Sri Triloki Singh, Advocate, holding brief of Sri K.R.Singh, learned counsel for the sole respondent.

This writ petition has been filed with the following prayer:

" Issue a order or suitable direction be issued to the Civil Judge, Senior Division, Gorakhpur to decide 7Ga application supported with Affidavit 8Ga filed in Original Suit No.97/2019, which is pending since 23.02.2019 be decided expeditiously, if possible, in a time bound order."

It is contended that the petitioner filed Original Suit No.97 of 2019 before the Court of Civil Judge (Senior Division) Gorakhpur claiming relief of permanent prohibitory injunction. An application 7Ga for interim injunction was also filed along with affidavit 8Ga. It is contended that the said application has not been decided till date. The only prayer is for early disposal of the interim injunction application 7Ga, pending in Original Suit No.97 of 2019.

Learned counsel appearing for respondent does not oppose the limited prayer made by counsel for the petitioner.

No useful purpose would be served in keeping the matter pending, as such, Civil Judge (Senior Division), Gorakhpur is directed to decide the interim injunction application (7Ga) filed in Original Suit No. 97 of 2019 (Smt. Poonam Tiwari vs. Gorakhpur Vikas Pradhikaran)), in accordance with law,

preferably within a period of next three months from the date of receipt of a copy of this order downloaded from the website of the High Court, after hearing all the parties concerned.
