Following orders were passed in the matter on 14.2.2020:-

"Petitioner has scored above 80% marks in the High School and Intermediate and has also scored good marks in the B.Sc. Ist and IInd year. In the B.Sc. IIIrd year, petitioner has failed. According to the petitioner her answer sheet has not been correctly evaluated and several questions have not been evaluated at all.

In the facts and circumstances of the case, it would be appropriate to direct the University to get petitioner's answer sheet in Mathematics and Physics paper in the B.Sc.IIIrd year course reevaluated from two other subject experts of the University provided petitioner deposits Rs. 2000/- with the Registrar of the University alongwith certified copy of this order within a period of one week from today. Opinion of the evaluators would be placed before this Court in a sealed cover within a fortnight.

In terms of the direction issued by this Court petitioner's answer sheets have been got reevaluated by the Gorakhpur University. The assessment by the Examiner has been placed in a sealed envelope by the Head of Departments of Physics and Mathematics of the University concerned.

From a perusal of the material placed on record it is pointed out that in Catch No. 430, there is increase of two marks in the Mathematics and one mark in Catch No. 428. Even after the reevaluated result the petitioner continues to remain failed. Similarly in the Physics Paper also the Examiner has found that no change is required rather the number in Catch No. 439 and 441 have reduced from 6 to 3 and 10 to 8 respectively.

In view of the opinion submitted by the Head of the Departments concerned, even after reevaluation of petitioner's copies, no improvement is made. In such circumstances, no relief is liable to be granted to the petitioner. Petitioner may put in more efforts and the remedy available to her is to further prepare for next examination.

The writ petition fails and is, accordingly, dismissed.
