Heard learned counsel for the petitioner and learned Standing Counsel for the State-Respondent.
Present Writ Petition under Article 226 of the Constitution of India has been filed for issuance of a writ of mandamus commanding the respondent Nos.2 & 3 to correct the date of birth of the petitioner as 15.1.1993 in place of 8.7.1994 in the online mark sheet.
It is contended by learned counsel for the petitioner that the marks sheet issued to the petitioner for High School examination 2009 is correct, but in the website portal of the Madhyamik Shiksha Parisad date of birth of the petitioner is incorrectly been shown as 8.7.1994 in place of 15.1.1993. It is further contended by learned counsel for the petitioner that the college has also written a letter to the Regional Secretary, Madhyamik Shiksha Parishad, Regional Office, Varanasi, respondent No.3 on 30.9.2019 for the aforesaid correction, but till date neither any correction was made on the website in the petitioner's mark sheet nor any decision has been taken. It is next contended by learned counsel for the petitioner that in this regard petitioner has filed representation dated 28.12.2019 before the Regional Secretary, Madhyamik Shiksha Parishad, Regional Office, Varanasi, respondent No.3, which remained pending.
Under these circumstances, direction is issued to the Regional Secretary, Madhyamik Shiksha Parishad, Regional Office, Varanasi, respondent No.3 to decide the representation of the petitioner dated 28.12.2019 as expeditiously as possible, preferably within a period of six weeks from the date of production of a certified copy of this order before him.
Writ Petition is, accordingly, disposed of.
