Sri Ved Byas Mishra, learned counsel for the respondent states that the prayer for renewal/transfer of licence in the name of the petitioner could not be executed by the respondent-Krishi Utpadan Mandi Samiti, Prayagraj for the reason that the succession certificate issued by the competent authority has not been submitted by the petitioner till date.

Learned counsel for the petitioner, however, states that the petitioner has filed a civil suit being Original Suit No. 611 of 2019 claiming relief for grant of succession in his favour. The said suit is pending before the competent civil court at Allahabad.

In view of the statement of Sri Ved Byas Mishra, learned counsel for the respondent, it appears that the succession certificate is necessary for transfer of the licence to run the shop in question by the petitioner. It further appears that there is some dispute regarding succession and hence the petitioner has filed the aforesaid civil suit.

Be that as it may, in view of the above fact, we do not find any reason to keep the writ petition pending. The writ petition is, accordingly, disposed of with the observation that the petitioner may submit succession certificate issued by the competent authority before the respondent No.1, alongwith an application seeking transfer of licence in his name alongwith a copy of this order. In case, such an application is filed, the respondent No.1 would be under obligation to take an expeditious decision in accordance with law, preferably within a period of four weeks from the date of receipt of the application.

The writ petition stands disposed of.
