Heard Sri Dhirendra Bahadur Singh, learned counsel for the petitioner and learned Standing Counsel for the State respondents.

By means of this petition under Article 226 of the Constitution, the petitioner has prayed for quashing of the order dated 19th October, 2019 passed by the Board of Revenue in a pending revision bearing No.- 2160 of 2019.

Briefly stated the facts of the case are that mutation application has come to be allowed by the Tehsildar concerned on 5th July, 2019 whereagainst revision has been filed before the Board of Revenue and in which the stay order has come to be stayed on 9th October, 2019.

The petitioner having challenged the order is now under notice of the pending revision before the Board of Revenue.

The interest of justice would be met in case a direction is issued to the Board of Revenue to decide the revision within a period of three months and the parties are directed to maintain status quo with regard to the nature and possession of the land in question and are further restrained from creating any third party rights in respect of the land in question.

Learned Standing Counsel also does not have any objection to that count.

In view of the above, the writ petition is disposed of with a direction to the petitioner to appear before Board of Revenue on or before 4th January, 2021 by moving such application/ objection as he may be advised and soon after appearance before the Board of Revenue, the Board of Revenue shall proceed to dispose of the matter finally on merits positively within a period of two months and until such disposal the parties are directed to maintain status quo with regard to the

nature and possession of the land in question and are further restrained from creating any third party rights in respect of the land in question.
