Heard Sri Virendra Singh, learned counsel for the petitioner and Sri Awadhesh Kumar, learned counsel for the respondent nos. 1,2 and 3.
By means of present writ petition, the petitioner has prayed for a writ of mandamus directing respondent no. 1 to consider and decide the application of the petitioner for family pension on account of death of of the sole bread earner on 19th July, 2010 in harness.
Learned counsel for the respondent does not dispute the fact that application dated 28.07.2020 moved by the petitioner is pending consideration before the District Basic Education Officer and submits that he has no objection in case if any direction is issued for disposal of the pending application of the petitioner within time bound period.
In view of above and without entering into the merits of the claim of the petitioner, the writ petition is disposed of with direction to the respondent no.1 to consider and decide pending application dated 28.07.2020 of the petitioner within period of two months from the date of production of copy of this order .
Learned Standing Counsel shall communicate this order to respondent no. 1 within 48 hours.
Copy of this order available on the official website of the High Court is genuine one. Learned counsel for the petitioner shall also supply certified copy of the order to the authority concerned as and when it is issued.
