Learned counsel appearing for the contesting respondents concedes that this petition would merit disposal in terms similar to those provided by a learned Judge while disposing of Writ-A No. 17184 of 2019. That petition was disposed of by the following order:-

"Heard learned counsel for the petitioners, learned Standing Counsel for respondent no.1 and Sri Jay Ram Pandey, learned counsel for respondent nos.2 and 3.

The petitioners are before this Court for a direction to the respondents to pay House Rent Allowance to all the petitioners at the rate payable to the employees of the Varanasi city in the light of the judgment rendered by Hon'ble the Full Bench of this Court in case of Uma Shankar Singh & Ors. v. State of U.P. and Ors., 2015 (8) ADJ 741 and also for a direction to the respondents to decide the representation of the petitioners dated 20.02.2019 in the light of the aforesaid Full Bench judgment.

At the very outset, learned counsel for the petitioners submits that similar controversy has also been raised before this Court in Writ-A No.37681 of 2017 (Neetu Verma & Ors. v. State of U.P. & Ors.) and this Court relying on the judgment in Uma Shankar Singh & Ors. (supra) disposed of the writ petition on 22.08.2017 giving a positive direction. As such it is contended that similar direction may also be passed in this writ petition also.

Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue and with the consent of learned counsel for the parties, the writ petition stands disposed of asking the third respondent i.e. Basic Shiksha Adhikari, Mirzapur to consider and decide the claim of the petitioners in accordance with law expeditiously and preferably within three months from the date of production of certified copy of this order."

In view thereof, this petition stands disposed of on similar terms.
