respondent no. 3, Assistant Director of Education (Basic) Meerut/Saharanpur Division vide his letter dated 16.03.2007 (Annexure No.6 to the writ petition) with regard to the appointment of Teachers and Ministerial Staffs and the specific objection, which was raised against the petitioner/appellant's appointment in the said letter, was that although her appointment had been approved as Class IV employee but the same was made without following the procedure prescribed. By the said letter, the respondent no. 3 sought guidance from the Director of Education. He next submitted that there is nothing on record indicating that the Director of Education (Basic) had responded to the letter of respondent no. 3 dated 16.03.2007 but on account of the aforesaid note/objection, the petitioner/appellant's salary was not paid. Accordingly, she has filed Civil Misc. Writ Petition No. 58845 of 2008 before this Court, which was illegally dismissed by the learned Single Judge without considering the material fact that objection which was raised by the respondent no. 3 vide letter dated 16.03.2007 was vague and there was nothing in the letter indicating that the respondent no. 3, Assistant Director of Education (Basic) had taken note of the fact that the petitioner's appointment had been made on compassionate ground and also without considering the fact that where even no vacant post is available, compassionate appointment can be made against a supernumerary post.
