Over and above this, claimants are entitled to an addition of 40% as deceased was admittedly of the age of 39 years four months on the date of the accident as his date of birth is mentioned as 15.03.1975. Therefore, with future prospect total annual dependency will come out to Rs.44,100/- (fourty four thousand and one hundred) on which there will be a multiplier of 15 as per the law laid down by Hon'ble Supreme Court in case of Sarla Verma (Smt) and others Vs. Delhi Transport Corporation and another as reported in (2009) 6 SCC 121 taking total pecuniary compensation of Rs.6,61,500/-(six lakhs sixty one thousand and five hundred). Over and above this, claimants are entitled to a sum of Rs.70,000/(seventy thousand) under the non-pecuniary head taking total compensation to Rs.7,31,500/- (seven lakhs thirty one thousand and five hundred) against Rs.4,42,000/- (four lakhs and fourty two thousand) awarded by learned Claims Tribunal. Therefore, there will be an enhancement of Rs.2,89,500/- (two lakhs eighty nine thousand and five hundred) to which claimants will be entitled and this enhanced amount shall also carry interest @ 7 % from the date of filing of the claim petition.
