Heard Sri Ashok Kumar Maurya, learned counsel for the petitioner and Sri J K Upadhyay, learned AGA for the State.
This writ petition has been filed by the petitioner seeking quashment of FIR dated 5.10.2019 in respect of Crime No.156 of 2019 for the offence under Sections 419, 420, 467, 468, 471 of IPC, Police Station Narahi, District Ballia.
Learned counsel for the petitioner, after arguing for some time, wants to withdraw this petition with liberty to file regular bail application before the Court below. He submits that in the eventuality of filing any such application by the petitioner, the Court below be directed to decide it on the same day or at least by the next date, as the petitioner is a Government employee.
State counsel has no objection insofar as withdrawal of the petition is concerned. He, however, submits that discretion be given to the Court below to decide the bail application in accordance with law.
Petition is, accordingly, dismissed, as withdraw, with the aforesaid liberty.
Needless to state that in the eventuality of filing any regular bail application by the petitioner before the Court below, it is expected from the Court below to decide the same expeditiously in accordance with law considering all aspects of the matter.
It is made clear that this Court has not expressed any opinion on the merits of the case and the competent court to act strictly in accordance with law.
